Consent for Pre-existing Material
- What type of recording do you want to use?
- Patient external recordings (that might identify the patient)
- Is there informed written patient consent?
- There is appropriate patient consent
- There isn't appropriate patient consent
- Here is some more information:
- Patient internal recordings (X-ray, internal organ, endoscopy, etc.)
- Patient anonymous data (ECG, lab data, clinical history)
- Other people (patients' relatives, hospital staff, volunteers, etc.)
Using Pre-Existing Material - Patient consent
If the pre-existing material you want to use contains:
- Recordings of patients (internal or external)
- Patient data (e.g. patient notes, ECGs, lab data, etc.)
- Recordings of other people such as staff, relatives, teachers, students, or the public
You need to check whether the consent obtained at the time of making the recording is adequate for your intended purpose:
- Whether there needed to be written consent if the recordings were to used for learning and teaching
- If so, whether such consent exists
- If so, whether this consent covers permission for you to use these recordings in the way that you intend
Patient consent is distinct from the question of whether the copyright owner of the recording will be willing to licence the recording for your intended use.
